1. Acceptance of Terms

By downloading, installing, or using the FAIRBUDDY mobile application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the App.

FAIRBUDDY is operated by SASU DECO SO, registered in France. These Terms apply to all users of the App, including trade fair professionals ("Sourcers") and suppliers who respond to sourcing questionnaires.

2. Description of Service

FAIRBUDDY is a B2B sourcing assistant designed to help trade fair professionals:

• Evaluate and compare suppliers encountered at trade fairs
• Generate and share multilingual supplier questionnaires via QR code
• Calculate landed costs including DOM-TOM Octroi de Mer
• Manage negotiation workflows and supplier communications
• Track and organize sourcing activities across multiple trade fairs

3. User Accounts

3.1 Registration

To access FAIRBUDDY, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Eligibility

The App is intended for professional use only. By creating an account, you confirm that you are using FAIRBUDDY in a professional or commercial capacity.

3.3 Account Security

You are responsible for all activities that occur under your account. You agree to notify FAIRBUDDY immediately of any unauthorized use of your account at [email protected].

4. Supplier Data & QR Code Forms

When a Sourcer generates a QR code and shares it with a supplier, the supplier submits information through a public form without authentication. By submitting information via this form, the supplier:

• Confirms that the information provided is accurate and complete
• Consents to the Sourcer storing and processing this data within FAIRBUDDY
• Acknowledges that uploaded product photos and certificates will be stored in Firebase Storage

Sourcers are solely responsible for the lawful collection and use of supplier data in accordance with applicable data protection laws.

5. Data Privacy & GDPR

5.1 Data Controller

SASU DECO SO acts as data controller for all personal data processed through FAIRBUDDY. Supplier data collected via QR forms is processed on behalf of the Sourcer.

5.2 Data Collected

FAIRBUDDY collects and stores:

• Account information (email, display name, profile photo)
• Supplier information (company name, contact details, product specifications)
• Uploaded files (product photos, certificates) stored in Firebase Storage
• Usage data and activity logs

5.3 Data Retention

Sourcer data is retained for the duration of the account. Users may request deletion of their data at any time by contacting [email protected].

5.4 Third-Party Services

FAIRBUDDY uses Firebase (Google) for authentication, database, and file storage. By using the App, you acknowledge that data is processed through these services in accordance with Google's Privacy Policy.

6. Intellectual Property

All content, design, code, and trademarks associated with FAIRBUDDY, including the FAIRBUDDY trademark (INPI registration no. 5221223), are the exclusive property of SASU DECO SO.

You may not reproduce, distribute, or create derivative works from FAIRBUDDY content without express written permission.

7. Acceptable Use

You agree not to:

• Use FAIRBUDDY for any unlawful purpose or in violation of these Terms
• Upload malicious content, spam, or misleading supplier information
• Attempt to reverse-engineer, hack, or compromise the security of the App
• Share your account credentials with unauthorized third parties
• Use the App to harass, defame, or harm any individual or entity

8. Limitation of Liability

FAIRBUDDY is provided "as is" without warranties of any kind. SASU DECO SO shall not be liable for:

• Any inaccuracies in supplier information submitted through the platform
• Business decisions made based on landed cost calculations
• Loss of data due to technical failures beyond our control
• Any indirect, incidental, or consequential damages arising from use of the App

The maximum aggregate liability of SASU DECO SO shall not exceed the amount paid by you for the App in the 12 months preceding the claim.

9. Subscription & Payments

FAIRBUDDY may offer subscription plans. Subscription fees are billed in advance on a monthly or annual basis. Cancellation must be made at least 24 hours before the renewal date through the App Store or Google Play settings.

Refunds are handled in accordance with Apple App Store and Google Play Store policies.

10. Termination

SASU DECO SO reserves the right to suspend or terminate your account at any time for violation of these Terms. Upon termination, your access to FAIRBUDDY will be revoked and your data may be deleted after a 30-day grace period.

11. Changes to Terms

FAIRBUDDY reserves the right to update these Terms at any time. Material changes will be notified via the App or by email. Continued use of the App after such notice constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by French law. Any dispute arising from the use of FAIRBUDDY shall be subject to the exclusive jurisdiction of the courts of France.
